These Terms and Conditions ("Terms") govern your use of ExpatEmergency roadside assistance services and website. By purchasing a membership or using our services, you agree to be bound by these Terms.

1. Service Description

ExpatEmergency provides roadside assistance coordination services for expats in Mexico, Costa Rica, Panama, Ecuador, and Colombia. Our services include:

• Towing service coordination (2 tows per year included)
• Jump start assistance
• Flat tire change assistance
• Fuel delivery coordination
• Lockout assistance
• 24/7 English-speaking support
• GPS tracking services (optional add-on)

2. Membership

2.1 Eligibility

Membership is available to individuals 18 years or older who own or regularly operate a vehicle in our coverage areas.

2.2 Membership Period

Annual memberships are valid for 12 months from the date of purchase. Membership is non-transferable.

2.3 Vehicle Registration

You must register your vehicle(s) with accurate information. Services are only available for registered vehicles.

3. Service Limitations

3.1 Coverage Area

Services are only available in designated coverage areas within Mexico, Costa Rica, Panama, Ecuador, and Colombia. Response times may vary based on location and service provider availability.

3.2 Included Services

Annual membership includes:

• 2 towing events per year (up to 50km per tow)
• Unlimited jump starts
• Unlimited flat tire changes (using your spare)
• Unlimited lockout assistance
• Fuel delivery coordination (fuel cost not included)

3.3 Exclusions

Our services do not cover:

• Accidents requiring emergency medical services (call 911)
• Vehicle recovery from off-road locations
• Commercial vehicles over 3.5 tons
• Motorcycles (unless specifically included in your plan)
• Mechanical repairs or parts
• Towing beyond the included distance (additional charges apply)
• Services needed due to illegal activity

4. Payment and Pricing

4.1 Membership Fees

Annual membership is $197 USD per year, payable in advance. Prices are subject to change upon renewal.

4.2 Additional Charges

Services beyond your membership inclusions (e.g., additional tows, extended towing distance) are subject to additional charges at prevailing rates.

4.3 Refunds

We offer a 30-day money-back guarantee for new members who have not used any services. After 30 days or first service use, memberships are non-refundable.

5. Service Providers

ExpatEmergency coordinates services through a network of independent, vetted service providers. While we carefully select our partners, we are not responsible for:

• Delays beyond our control
• Quality of repairs performed by third parties
• Damage to vehicles not caused by our service providers
• Items left in towed vehicles

6. Your Responsibilities

As a member, you agree to:

• Provide accurate vehicle and contact information
• Be present with your vehicle when requesting service
• Ensure your vehicle is legally registered and insured
• Not misuse the service for non-emergency situations
• Follow instructions from our support team and service providers

7. GPS Tracking Service

If you opt into our GPS tracking add-on:

• You consent to continuous location tracking of your vehicle
• Location data is stored securely and used for theft recovery and emergency response
• You may disable tracking at any time by contacting us
• Monthly service fees apply as quoted at enrollment

8. Limitation of Liability

To the maximum extent permitted by law:

• Our liability is limited to the membership fee paid
• We are not liable for indirect, consequential, or incidental damages
• We do not guarantee response times or service availability
• Force majeure events release us from service obligations

9. Termination

We may terminate your membership for:

• Fraudulent use of services
• Abusive behavior toward staff or service providers
• Providing false information
• Non-payment of additional charges

10. Modifications

We reserve the right to modify these Terms at any time. Continued use of our services after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by applicable laws. Any disputes shall be resolved through arbitration in a mutually agreed location.
